    • Tobacco filters, wet wipes
    • Fishing gear
    Triggering activities

    • Selling beverages in plastic bottles
    • Importing banned items (straws, cutlery)
    Extraterritorial reach
    Yes

Product bans and design rules apply to imports; foreign makers must meet cap, marking and recycled-content rules.

    Examples
    • Chinese maker of disposable tableware
    • Beverage brand bottling for the EU
    • Importer of wet wipes and sanitary items

    What the law requires

    • Stop placing banned items (cutlery, plates, straws, EPS cups) on the market
    • Attach caps to bottles up to 3 litres
    • Meet recycled-content shares in PET and plastic bottles
    • Apply harmonised marking and finance EPR clean-up costs

    Penalties

Set by Member States (Art. 14); must be effective, proportionate and dissuasive.

What this changes for a supplier in China

Chinese makers of disposable items lose EU market for banned products. Bottle and cap makers must prove tethered design and recycled content.

    Expected evidence

    • Material declaration (plastic vs alternative)
    • Recycled content certificate (rPET)
    • Marking artwork per Reg. 2020/2151
